Needs Assessment

The Harris County Needs Assessment regarding Hurricane Harvey recovery and unmet needs has been submitted to the Texas General Land Office on October 26, 2018. This plan will assist the county to develop programs utilizing Community Development Block Grant – Disaster Recovery (CDBG-DR) Round 1 funds in the amount of $1,115,386,830.

Harris County Supplemental Action Plan

The U.S. Department of Housing and Urban Development (HUD) has allocated $5.024 billion in Community Development Block Grant Disaster Recovery (CDBG-DR) funds to the state of Texas in response to Hurricane Harvey, DR-4332, through the publication of the Federal Register, Vol. 83, No. 28, Friday, February 9, 2018. This allocation was made available through the Continuing Appropriations Act, 2018 and Supplemental Appropriations for Disaster Relief Act, 2017 that allocated $7.4 billion in CDBG-DR funds in response to major disasters declared in 2017. In their Action Plan submitted to U.S. HUD on May 8, 2018, the State of Texas, under their program administer the Texas General Land Office (GLO), made a direct allocation of $1,115,386,830 in Community Development Block Grant Disaster Recovery (CDBG-DR) funding (Round 1) to Harris County.

A Draft Supplemental Action Plan has been developed by Harris County to program these funds and submitted to the GLO. The original Draft Supplemental Action Plan, which was approved by the Harris County Commissioners Court on July 10, 2018, was incorporated into the State of Texas Plan for Disaster Recovery – Hurricane Harvey Round One (CDBG-DR) as Amendment One by the GLO. The GLO submitted Amendment One to HUD in October 2018 and HUD approved Amendment One on December 11, 2018.

Guidelines

Guidelines have been created for each of the CSD disaster recovery programs to define the parameters and purpose of each program, and how it will work to help the County meet an unmet need.

The guidelines establish eligibility for and distribution of program funds.

Fraud, Waste & Abuse

The Harris County Community Services Department welcomes feedback and complaints from any member of the public. Complaints of fraud, waste or abuse must be immediately reported by calling the hotline at 866-556-8181.

Complaints & Appeals

The Harris County Community Services Department (HCCSD) has a systematic appeal and complaints process so that applicants and participants have recourse when they feel HCCSD, its vendors or any of its Project Recovery programs have made an adverse determination of eligibility, benefits or award/offer amount.

A complaint or appeal must be submitted as outlined below:

Complaints are to be submitted in writing, or in person at the main CSD office, or by phone by contacting CSD at 832.927.4700 and will be responded to within 15 business days of the receipt of the complaint.

Appeals Process for All Project Recovery Programs Except Post Disaster Relocation and Buyout Program

Applicants have the right to file an appeal regarding their award within 10 days of the date on the face of the determination letter. After 10 days, the status is final and can no longer be reviewed. Appeals must be in writing in order to be valid. The final decision will be sent to the applicant in an Appeals Decision Letter. If the decision is unsatisfactory, applicants may further appeal to the Texas General Land Office (GLO), whose contact information can be found below.

Appeals Process for Post Disaster Relocation and Buyout Program

An aggrieved acquisition/buyout participant may file a written appeal with HCCSD in any case in which the participant believes that the Project Recovery Staff has failed to properly consider their application for assistance under the Uniform Relocation Act (URA) and program guidelines.

The participant must file the appeal in writing within 60 business days after receipt of the determination letter. After 60 days, the status is final and can no longer be reviewed, except for reasonable accommodation requests, which will be reviewed on a case-by-case basis. A determination will be sent to the participant in an Appeals Decision Letter. The participant may accept the decision, seek judicial review of the decision, or request a review by the Texas General Land Office (GLO). The GLO will only review an appeal after the participant has exhausted Harris County remedies.

GLO Appeals Information

Complainants and appellants should initially contact their local jurisdiction (Harris County Community Services Department) in accordance with their local policies and procedures for customer complaints. However, should the complainant or appellant not be satisfied with the outcome of their process with HCCSD, they have the right to escalate the complaint or appeal to the Texas General Land Office (GLO). The GLO will provide a timely response. The response will be provided within 15 working days of the receipt of the complaint or appeal, if possible.

SECTION 3

Section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u), as amended, requires that Harris County  ensures that training, employment, and other economic opportunities generated by certain HUD financial assistance for housing and community development programs shall, to the greatest extent feasible, be given to low- and very low- income persons.  Particularly those who are recipients of governmental assistance for housing, and to businesses that provide economic opportunities for these persons.

CONTRACTING WITH SMALL AND MINORITY FIRMS, WOMEN’S BUSINESS ENTERPRISE, AND LABOR SURPLUS AREA FIRMS

It is national policy to award a fair share of contracts to small and minority business firms, as well as women-owned firms.  Accordingly, affirmative steps must be taken by Contractors to assure that small, minority, or women-owned businesses are utilized when possible as sources of supplies, equipment, construction and services, especially from labor surplus areas.
